On January
8, 2004, the Commonwealth Court of Pennsylvania issued an
order STAYING “all court actions, arbitrations, mediations
and discovery pending or hereinafter filed against PPG and
its Program participants” pending the Supreme Court of
Pennsylvania’s decision on the appeal, filed by the liquidator
of Legion, to overturn the “direct access” to reinsurance
provisions of the Commonwealth Court’s June
26, 2003 opinion and July
25, 2003 liquidation order.
On September
21, 2004, the Supreme Court of Pennsylvania ordered that it
will hear oral argument on the Legion statutory liquidator’s
appeal of the Commonwealth Court’s Orders. The
oral argument occurred as scheduled on March 8, 2005. On
July 19, 2005, the Supreme Court of Pennsylvania affirmed
the Commonwealth Court’s order (www.courts.state.pa.us/OpPosting/index/SupremeArchieve/
month.asp?date1=07/01/2005&date2=07/31/2005).
